Supreme Court of India has delivered a landmark judgement regarding abortions, giving full rights to the women to decide on abortion. The apex court underscored that irrespective of marital status, every woman has right to abortion, if she chooses.
The SC bench headed by DY Chandhrachud reasoned that there should not be any distinction between married and unmarried women in case of abortions, and any woman irrespective of her marital status has right to safe and legal abortion. According to the judgement, women, whether they are married or single, can choose to undergo abortion till 24 months of pregnancy.
This SC judgement is considered as landmark as it took into consideration various social, cultural, health scenarios while giving the complete rights over abortion to the women. The judgement ensures that even a pregnancy arising out consensus relationship can be terminated if woman chooses. This judgement is seen as a saviour for rape victims, women stuck in abusive marriages, woman becoming pregnant forcibly without their consent or other difficult situations.
