Supreme Court of India has made it clear that child pornography is a crime under any circumstances and in any form. The Supreme Court said that downloading and storing child pornography content is not an offence under the Pocso Act and ruled that the High Court’s judgment was an egregious error.
The CJI-led bench ordered that the courts should not use the term child pornography. In this regard, the Supreme Court rejected the judgment of the Madras High Court in a hearing held on Monday.

A 28-year-old man has been arrested by the Tamil Nadu police for allegedly downloading child pornography videos. An FIR was registered under the POCSO Act and filed in the court. After the lower court passed the sentence, the youth approached the Madras High Court. The Madras High Court ruled last January that criminal proceedings against the young man should be stopped after the trial.
Several petitions were filed in Supreme Court against this verdict. A bench of Justice JB Pardiwala and Justice Manoj Mishra headed by CJI Justice DY Chandrachud heard the petitions on Monday and the bench overruled the judgment of the Madras High Court.
